  • "Intellectual Property" includes all copyrights, trademarks, trade secrets, patents, proprietary information, and other intellectual property rights.

2. Acceptance and Binding Agreement

By accessing, browsing, or using this website (allsteel.co.za and all subdomains), ordering products, or using our services, you acknowledge that you have read, understood, and agree to be legally bound by all terms of this Agreement, as well as our Privacy Policy.

This agreement becomes effective upon your first access to the website and remains in effect until terminated in accordance with these terms.

3. Comprehensive Intellectual Property Rights

3.1 Protected Assets

This website and all associated digital assets constitute proprietary intellectual property owned exclusively by All Steel Services CC, including but not limited to:

  • Source code, compiled code, scripts, and software architecture
  • Website design, layout, color schemes, typography, and visual elements
  • Content, text, copy, marketing materials, and technical documentation
  • Images, graphics, logos, icons, videos, and multimedia content

3.2 Strict Usage Prohibitions

The following activities are strictly prohibited without express written authorization:

  • Reproduction or copying of any website elements, in whole or in part
  • Reverse engineering, decompilation, or disassembly of software components
  • Creating derivative works based on our intellectual property
  • Screen scraping, data mining, or automated data extraction
  • Replicating functionality, design patterns, or business processes

3.3 Media and Asset Licensing

All visual and multimedia content is either:

Assets are non-transferable and may not be downloaded, extracted, or reused. Proof of licensing is maintained in our records.

4. Products and Services

4.1 Product Information

We strive to provide accurate descriptions of our steel products and services. However, we do not warrant that product descriptions or other content on our website are accurate, complete, reliable, current, or error-free. All specifications are subject to industry tolerances and standards.

4.2 Availability and Pricing

All products and services are subject to availability and market conditions. Steel prices fluctuate based on market forces, and prices for our products are subject to change without notice. We reserve the right to modify or discontinue any product or service without notice.

4.3 Custom Orders and Fabrication

For custom-cut steel orders and fabrication services:

  • Specific technical requirements and tolerances apply
  • Once approved by you and production has begun, cancellations or modifications may not be possible
  • Additional charges may apply for changes after production commencement
  • Custom orders typically require longer lead times and may be non-returnable

4.4 Technical Specifications

All steel products conform to applicable South African SABS standards and international standards (SANS, ASTM, etc.). Technical specifications, certificates, and test reports are available upon request for qualifying orders.

5. Orders, Payment & Quotations

5.1 Order Acceptance

Your order constitutes an offer to purchase our products or services. We reserve the right to accept or decline your order for any reason, including but not limited to:

  • Product availability and stock levels
  • Errors in product or pricing information
  • Problems identified by our credit verification procedures
  • Capacity constraints or scheduling conflicts

5.2 Payment Terms

Payment terms vary based on customer status and order size:

  • Cash sales: Payment due in full at time of order
  • Account customers: Net 30 days from date of statement (subject to credit approval)
  • Large orders: Deposit may be required before production
  • Custom work: 50% deposit typically required

We accept cash, EFT, credit cards, and approved company accounts. Late payment charges may apply to overdue accounts.

5.3 Price Quotations

Price quotations are valid for 7 days from the date of issue unless otherwise specified. After this period, prices may be subject to change based on:

  • Market steel price fluctuations
  • Material cost changes
  • Exchange rate variations
  • Fuel and transportation costs

6. Delivery and Collection

6.1 Delivery Options

We offer various delivery options within our service areas:

  • Standard delivery: Within Gauteng province
  • Extended delivery: Other provinces (additional charges apply)
  • Express delivery: Same-day or next-day (subject to availability)
  • Customer collection: From our Germiston facility

6.2 Delivery Terms

Important delivery conditions
Delivery times are estimates only and are not guaranteed. Risk of loss and title pass to you upon delivery to carrier or collection.
  • Adequate access and unloading facilities must be available
  • Additional charges apply for crane trucks or special handling
  • Weather and traffic conditions may affect delivery schedules

6.3 Collection Procedures

For customer collection:

  • Valid identification and order confirmation required
  • Collection during business hours: Monday–Thursday 7:30–16:30, Friday 7:00–13:30
  • Suitable vehicle and lifting equipment required for heavy items
  • Safety equipment (hard hats, safety boots) required on premises

7. Returns, Refunds & Warranties

7.1 Inspection of Goods

You must inspect all products upon receipt and notify us of any defects, damages, or discrepancies within 48 hours of delivery or collection. Failure to notify within this timeframe may limit your recourse options.

7.2 Return Policy

  • Standard stock items: May be returned within 14 days if in original condition and packaging
  • Custom-cut items: Cannot be returned unless defective or not as specified
  • Specially ordered items: Non-returnable unless manufacturing defects exist
  • Contaminated or damaged items: Cannot be accepted for return

7.3 Refund Process

Approved refunds will be processed as follows:

  • Refunds issued using original payment method
  • Processing time: up to 14 business days
  • Delivery charges generally non-refundable
  • Restocking fees may apply (typically 15–25%)

7.4 Product Warranties

Our products are warranted to be free from manufacturing defects under normal use conditions. This warranty does not cover damage from misuse, corrosion, or normal wear and tear. Warranty periods vary by product type and are specified at time of sale.

You agree to indemnify, defend, and hold harmless All Steel Services CC, our affiliates, officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

11. Force Majeure & Business Continuity

11.1 Force Majeure Events

  • Third-party service provider outages
  • Labor disputes, strikes, or supply chain disruptions
  • Material shortages or transportation delays
  • Utility failures or equipment breakdowns

11.2 Business Continuity

During force majeure events, we will:

  • Make reasonable efforts to minimize service disruptions
  • Communicate with affected customers about delays
  • Implement alternative solutions where possible
  • Resume normal operations as quickly as practicable

12. Modification and Termination Rights

12.1 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. 12.2 Termination Rights

This agreement may be terminated:

  • By users: At any time by ceasing website use and closing accounts

13. Dispute Resolution & Governing Law

13.1 Governing Law

These Terms shall be governed exclusively by the laws of the Republic of South Africa, without regard to conflict of law principles.

13.2 Jurisdiction and Venue

All disputes shall be resolved - each party consents, in terms of section 45 of the Magistrate's Court Act 32 of 1944, to the jurisdiction of the District Magistrate's Court in respect of any proceedings pursuant to this agreement. Users consent to exclusive jurisdiction and waive objections to venue. International users remain subject to South African law for this agreement.

13.3 Structured Dispute Resolution Process

    Direct Negotiation: 30 days written notice and good faith discussions between parties.

    Mediation: If negotiation fails, non-binding mediation in Johannesburg.

    Arbitration / Litigation: Final resolution through South African courts or the Arbitration Foundation of South Africa, as elected by All Steel CC.

13.4 Third-Party Links

Our website may contain links to third-party websites or services not owned or controlled by All Steel Services CC. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

14. Final Provisions

14.1 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

14.2 Entire Agreement

These Terms constitute the entire agreement between you and All Steel Services CC regarding our services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning our services.

14.3 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

14.4 Waiver

No waiver of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

14.5 Enforcement and Remedies

Violations of this agreement may result in:

  • Immediate termination of access privileges
  • Legal action for damages and injunctive relief
  • Criminal prosecution where applicable
  • Recovery of attorney fees and court costs
